- Procurement Unit (PU) Publishes Notice of Preferred Bidder following Accounting Officer’s (AO) award decision. The notice also indicates cooling off period.
- PU issues communication to both the successful bidder indicating intention to award and also to unsuccessful bidders.
- PU also notifies unsuccessful bidders about their legal right to request debrief within the cooling off period in Accordance with Section 104 of the Act and Public Procurement Regulation,2023 (PPR)Regulation 68(8).
- If no request for debrief is submitted the AO proceeds to award the tender after the elapse of the cooling off period. Communication to bidders is shared by Procurement Unit.
- Bidders who request for debrief submits their request to procurement@ub.ac.bw before the elapse of the cooling off period.
- Debrief is conducted during the cooling off period by the Ad -Hoc Debrief committee appointed by the accounting officer.
- If no complaint has been lodged after the debriefing period, then the AO proceeds to award the tender after the elapse of the cooling off period.
- Should the bidder feel aggrieved after the debrief session then the bidder submits a complaint to the AO via email to: vc@ub.ac.bw and CC: procurement-oversight@ub.ac.bw
- Pursuant to Reg 68(11), the AO shall where a bidder has lodged a complaint during the cooling off period notifies all other participating bidders and resolve the complaint within 14 days of receipt of such compliant before he proceeds with the procurement process.
- The AO should then communicate his adjudication decision regarding the complaint to the aggrieved bidder within 14 days.
- Should the complainant not be satisfied with the decision of the AO on the lodged complaint then the complainant should lodge an appeal to the Public Procurement Tribunal.
NB: All complaints are handled in line with applicable provisions of Botswana, s Public Procurement Act and Public Procurement Regulations 2023.
